1. Acceptance of Terms

By downloading, installing, or using the Keeper mobile application ("App") or visiting keeperfishingapp.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Website.

 

2. Eligibility

You must be at least 13 years of age to use Keeper. If you are between 13 and 18, your parent or legal guardian must have reviewed and agreed to these Terms.

 

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to notify us immediately at support@keeperfishingapp.com if you become aware of any unauthorized use.

 

4. Description of Service

Keeper is a mobile fishing-log application that allows users to record and organize catch data, track fishing locations and patterns using map and heat map features, host and participate in fishing tournaments, share catches with other users, and export catch data. Some features require a paid Pro subscription (see Section 5).

 

5. Subscriptions and Payments

Free Tier: Keeper offers a free tier with limited functionality, including up to 20 catch logs, catch log filtering, and map pin filtering.

Pro Subscription: Keeper Pro is available for $2.99/month or $29.99/year and unlocks additional features including unlimited catch logging, photos, data export, heat maps, lake insights, tournament mode, and more.

Billing: Subscriptions are billed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation: You may cancel at any time through your App Store or Google Play subscription settings. You will retain Pro access until the end of your current billing period. We do not offer refunds for partial billing periods.

 

6. User Content

You retain ownership of all content you submit to Keeper, including catch data, photos, and notes. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of providing the Keeper service to you.

You agree not to submit content that violates any applicable law, infringes third-party rights, or contains harmful or inappropriate material. We reserve the right to remove content that violates these Terms.

 

7. Prohibited Conduct

You agree not to use the App for any unlawful purpose, attempt to gain unauthorized access to our systems or other users' accounts, reverse engineer or decompile any part of the App, use automated tools to access the App in a manner that exceeds normal usage, or impersonate any person or entity.

 

8. Intellectual Property

The Keeper name, logo, App, and all content created by us are our exclusive property, protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without prior written permission.

 

9. Third-Party Services

The App integrates with third-party services including Supabase, Mapbox, Open-Meteo, and Sentry. Your use of these services is subject to their respective terms. We are not responsible for the practices of these third parties.

 

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

 

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10.00, WHICHEVER IS GREATER.

 

12. Indemnification

You agree to indemnify and hold harmless Keeper and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the App, your User Content, or your violation of these Terms.

 

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately.

 

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notice or email. Your continued use of the App after the effective date constitutes your acceptance.

 

15. Governing Law

These Terms are governed by the laws of the United States.
